    Shhhhh. Don't tell the faux patriots around here that bandanas etc desecrate our great flag.

    We know el rushbo won't tell them so I guess it ain't real.

    If these kids didn't mean their choice of clothing to be offensive to the other students, why can't one of them say "I didn't mean to offend anyone, I'm sorry if I did"?

    1. Because why should they apologize for someone else being oversensitive? I know I wouldn't. Especially after I'd already been punished unfairly. It's not on them to apologize for other peoples issues, especially over something as innocent as wearing an American flag shirt in America on a holiday that Mexicans don't celebrate and has nothing to do with America. Like I said, it's not like they wore something that was an attack on Mexico or those of Mexican heritage (since it appears that both are of Mexican descent themselves.).

    2. Even if they were wearing the shirts to annoy people, that's not illegal when last I checked, any more then it is for an atheist to wear a "There is no God" shirt on Easter, or something else along those lines.

    the Mexicans who beat up the kids? Well, yes, because they're breaking the law and physically hurting other people. There is no constitutional right to beat the crap out of people, but there is freedom of speech/expression, including the clothes.

    Ah, there's the rub Mr Attorney. It would end up being a he said, she said. Whose to know what the flag desecrators were doing to provoke this hypothetical scenario.

    No one on this forum was there. The OP picked one anecdotal instance of a school administrator doing what he thought was prudent to keep overall safety at his school.

    He said, she said? Yeah, he would say "I wore this shirt to annoy people", and she would say "His shirt annoyed me, so I beat him up", and she would go to jail. One of them is against the law, the other is not.

    Sorry, you'll never convince me it is cool to stop kids in America from wearing American flag shirts just because it annoys people of another culture.

    If you want to argue the flag desecration angle, that's a more palatable thing, but unfortunately that is a law that, as M Richardson noted, has no teeth and has gone unenforced for a long time.

    Why wouldn't you apologize? If you unknowingly did something that offended someone what's wrong with saying "I'm sorry I offended you, it wasn't intentional"?

    I don't think anyone is saying it is illegal, what it is is against school policy.

    Because it's their problem, not my own. Should I apologize for everything I ever do that offends SOMEBODY? What do I do in a situation where whatever decision I make, no matter how innocuous, offends someone? If I make a joke or comment that offends someone? Sure, I'll apologize. If I bump into someone on the street, I'll apologize. But for wearing a shirt bearing the symbol of my country while in my country? Not happening. It's not like they wore an incendiary symbol like a confederate flag to a mostly black school.

    I just don't see how this was insensitive. All of these students at this school were Americans, even if they have Mexican heritage, so how is it insensitive to them to wear American flags?

    How so? The school district even released a statement saying the school mishandled the situation.
