Default He deserved it but it seems wrong

Given the theme of the burning man this just seems wrong....

RENO, Nev. - A San Francisco performance artist was sentenced Friday to as many as four years in prison and ordered to pay restitution for the early torching last summer of the signature effigy of the counterculture Burning Man festival.
I am 49, bald, ugly, and don't own a single cool thing. Kids like me though.

I guess by the letter of the law he's guilty, but man, that sucks. 4 years for burning something that was scheduled to be burned 4 days later?

No, he is being penalized for taking away from thousands the climax of their week. He destroyed something that was not his to destroy.

They made another one in time and destroyed it anyway. Make him pay for the reconstruction, whatever, but jail for 4 years?

    1. He destroyed property. If someone burned down your barn but you were able to construct another in a few days, would you argue that 4 years was too harsh?

    2. Public safety. The article doesn't mention this aspect, but someone who starts a big fire may put the public at great risk.

I guess I don't have a lot of sympathy for arsonists. Note that he's been convicted of the same before.

With regards to number 1, was I planning on burning the barn down anyway? Then I think that paying to rebuild the barn so I could burn it in a public ceremony is fine, but jail seems harsh.

With regards to number 2, an obviously fair point that we would need facts on.

With regards to being convicted of arson, I missed that part.

seems harsh. but what an idiot. you have to punish fools like him it's just a shame it's at tax payers expense. a big fine would have been more in line with community service for 1000 hours and probation for 36 mos.
but then again, i may be retarded

As to Number 1: No, I guess I wasn't planning on burning the barn down anyway so not the best analogy. But, the point is: we tend to hold property as sacrosanct in this country, including the inherent right to do with it as we wish. No matter that I was going to burn it anyway, I didn't get to do it my way.
