    Default Don't Forget Your Court Date..

    What's the cost of not showing up to court? For PepsiCo Inc., it's a $1.26 billion default judgment. A Wisconsin state court socked the company with the monster award in a case alleging that PepsiCo stole the idea to bottle and sell purified water from two Wisconsin men.

    Now the company is scrambling to salvage the situation. The damages award was handed down on Sept. 30. PepsiCo filed motions to vacate the order and dismiss the claims on Oct. 13, saying it wasn't even aware of the lawsuit until Oct. 6.

    Since the error was in Pepsi's court, they better hope for a lenient judge. There is a reason default judgements exist.

    As for Pepsi's claim too much time has passed, I suggest they review the Craftsman Socket Wrench case. The inventor brought his patent infringement claim some 30+ years after Sears began selling his design and the courts allowed him to pursue his case. He ultimate won big bucks - essentially every dime of profit Sears gained from the sale of every single socket wrench. You'll notice the current Craftsman socket wrench is a different design with the ejection button on top.
